Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and TutorByPin ("we", "our", "us") and govern your access to, and use of, tutorbypin.com and any associated applications (collectively, the "Platform").

By creating an account, publishing a listing, unlocking a contact, or otherwise interacting with the Platform, you confirm that you have read, understood and agreed to these Terms. If you do not agree, do not use the Platform.

• Student — a learner (or a parent/guardian acting on their behalf) who uses the Platform to discover tutors.
• Tutor — an independent educator who publishes a profile or listing on the Platform.
• Contact Unlock — the paid action that reveals a tutor's phone / email to a student.
• Unlock Credits — the pre-purchased virtual balance used to perform a Contact Unlock or publish certain listings.
• Session — the tuition arrangement agreed directly between a Student and a Tutor, off-platform.

The Platform is intended for users who are at least 18 years old and can enter into a binding contract under applicable law. Students under 18 must have a parent or legal guardian create and manage the account. By registering you represent and warrant that the information you provide is accurate and up to date.

A verified email address is required to activate a TutorByPin account. You are responsible for maintaining the confidentiality of your credentials and for every action taken under your account.

• Only one active account per person.
• You must promptly update your profile if the information changes.
• Notify us at once if you suspect unauthorised use of your account.

As a Tutor, you agree that:

• All information on your profile and listings is accurate, truthful and lawful.
• Your qualifications, certifications and experience claims can be substantiated if requested.
• You will respond professionally to students who unlock your contact and honour the availability windows you publish.
• You will not solicit payments outside agreed session fees or attempt to circumvent Platform fees for services routed through the Platform.
• You are solely responsible for calculating and paying any taxes on income earned from Sessions.

As a Student (or parent using the account on a student's behalf), you agree that:

• You will contact tutors only for genuine tuition needs — bulk scraping, marketing outreach or nuisance messaging is prohibited.
• You will independently verify a tutor's credentials, references and safeguarding checks before engaging them, especially for in-person sessions.
• You are responsible for any Session fees agreed with the tutor directly.
• You will treat every tutor with courtesy and comply with reasonable cancellation notice.

TutorByPin is a discovery marketplace, not a school, tuition centre or employer of tutors. We facilitate introductions between students and independent tutors — we do not verify every credential, deliver classes, guarantee outcomes or set the price of a Session.

Any contract for tuition is formed directly between the Student and the Tutor and is entirely their responsibility.

• Contact Unlocks reveal the tutor's stored phone and email at the moment of unlock.
• Each unlock is single-use per Tutor per Student — repeat unlocks against the same Tutor do not cost additional credits within the visibility window we display.
• Unlocked contact information is provided for the Student's personal use only. You may not resell, publish, syndicate or otherwise redistribute it.
• Any misuse (spam, scraping, harassment) will result in account suspension without refund.

Payments made on the Platform (credit-pack purchases, subscription plans) are processed by regulated payment aggregators. All amounts are shown in Indian Rupees (INR) and are inclusive of applicable indirect taxes unless stated otherwise.

Payments made directly to a tutor for a Session (cash, UPI, bank transfer, etc.) are outside the scope of the Platform and outside the scope of any TutorByPin refund process.

Unlock Credits are prepaid virtual balances used to spend on marketplace actions.

• Credits are non-transferable between accounts.
• Credits have no cash value and cannot be redeemed for cash.
• Unless expressly stated in the specific offer, purchased credits are valid for 12 months from the date of purchase.
• Refund eligibility for unused credits is governed by the Refund Policy.

You must not, directly or indirectly:

• Impersonate another person or misrepresent your affiliation with any entity.
• Post fake reviews, testimonials or ratings.
• Scrape, crawl, or bulk-download data from the Platform.
• Attempt to bypass the Contact Unlock mechanism (e.g. posting contact details in your profile bio or listing description).
• Use the Platform to solicit for anything other than legitimate tuition services.
• Upload malware, exploit vulnerabilities, or otherwise interfere with the Platform's security or availability.
• Post content that is unlawful, defamatory, obscene, discriminatory or that infringes on any third party's intellectual-property rights.

The TutorByPin name, logo, Platform design, source code, algorithms and content that we create are our intellectual property or that of our licensors and are protected by copyright, trademark and other laws.

You retain ownership of any content you upload (profile text, photos, listing descriptions). By posting such content you grant TutorByPin a worldwide, royalty-free, non-exclusive licence to host, display, reproduce and distribute it on the Platform for the purpose of operating and promoting the service.

We may temporarily suspend your account, listings, or specific features (such as Contact Unlocks) if we reasonably believe you have breached these Terms, if we detect fraudulent or abusive behaviour, or if we are required to do so by law. Where possible, we will notify you of the reason and give you an opportunity to respond.

You may close your account at any time from the dashboard or by writing to us. We may terminate accounts for repeated or serious breaches of these Terms. Termination does not entitle you to a refund of unused credits acquired through promotional offers or bonus schemes. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) shall survive.

The Platform is provided on an "as is" and "as available" basis. TutorByPin makes no warranties, express or implied, regarding the quality of any tutor listed, the outcome of any Session, the accuracy of any listing, or the availability of the Platform at any given time.

You are solely responsible for your due diligence when choosing a tutor, including background checks, safeguarding checks and any qualifications verification you deem necessary.

To the maximum extent permitted by law, TutorByPin's aggregate liability arising out of or in connection with your use of the Platform is limited to the amount you paid to TutorByPin in the 12 months preceding the event giving rise to the claim, or INR 5,000 — whichever is lower.

TutorByPin will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka.
